Welcome to Setu Consulting Services Pvt Ltd(“we” or “us”). These Terms and Conditions of Use ("Terms") are effective as of 1st April, 2023 and will remain in effect unless modified or terminated by us. We reserve the right to modify these Terms and Conditions at any time, and such modifications will be effective immediately upon posting on our website. These Terms and Conditions of Use ("Terms") govern your use of our consulting services ("Services") and our website ("Website"). Software Development and Consulting Services :

These Terms and Conditions ("Terms") shall apply and govern the Statement of Work(s), project, letter of intent, or any other document ("SOW") executed between Setu Consulting Services Pvt Ltd or any of its affiliates [specifically identified in the SOW] ("Consultant/Consultant") and Customer, for the purpose of providing professional services ("Services") or deliverables ("Deliverable") for software development and consulting.

Limitation of Liability and Disclaimer of Warranties :

Setu Consulting Services Pvt Ltd and the Customer agree that liability under the Agreement shall not exceed the fees paid, whether in contract or tort (including negligence). The parties disclaim any responsibility for indirect, special, consequential, or incidental damages or loss of revenue or business profits, even if informed of the possibility. These liability limitations apply even if any limited remedy fails.

Our services are provided "as is" without any express or implied representations or warranties. Although we use reasonable skill and care, we cannot guarantee that our services will meet your requirements or be error-free. We are not liable for any damages, including direct, indirect, incidental, consequential, or punitive damages, arising from your use or inability to use our services or content errors or omissions. By using our services, you agree to indemnify and hold us harmless from any claims, liabilities, damages, and expenses, including attorneys' fees, arising from your use.

You agree to use our services in accordance with all applicable laws and regulations. You must not use our services for any illegal or unauthorized purpose and to not engage in any activities that may harm Setu Consulting Services or any third party. You must also not interfere with or disrupt the integrity or performance of our services.

You agree not to use our Website or Services for any illegal, fraudulent, or unauthorized purpose. You must not use our services if you have been suspended or banned from using them. You must not use our services for any commercial purpose without our prior written consent. No seller is allowed to resell our products or services without prior permission. To use products, software solutions you must purchase it from us or odoo app store and not from and third party.

Cancellation and Refund Policy :

At Setu Consulting Services Pvt Ltd., we strive to provide the highest quality services to our clients. If, for any reason, you are not satisfied with our services, we offer a cancellation and refund policy, subject to the terms and conditions below :

Refund Requests : To initiate a refund request, please contact us via email or phone. We will respond to your request within 2 business days.

Refund Processing Time : We will process your refund within 7 business days of receiving your request, provided that the request meets the conditions outlined below. The refund will be issued in the original form of payment.

Conditions for Refund : We will issue a refund in the following cases:

  • The Customer cancels the service request before work has begun on the project, and the payment has been received.

  • If we fail to develop the specifications mentioned in the requirements of the project and the payment has already been received.

  • The issue concerns a bug that has not been fixed within the allotted time

  • The module is lacking a feature that is advertised on the app description page

No Refunds : We do not offer refunds in the following cases:

  • The customer cancels the service request after work has begun on the project.

  • The customer fails to provide the necessary information or support required to complete the project.

  • The seller or customer has modified the source code of the application or work that we have done.

  • The customer fails to provide the necessary information or support required to resolve issues that persist in the application purchased.

  • The claim concerns a new feature, that was not mentioned in the description of the module, nor in the communication with the customer

  • The module had a bug that we are able to fix following the claim

  • The module works well, but is not satisfying the customer’s specific needs

  • The customer purchased the wrong version of the application for his database.

Changes to Terms and Conditions :

We reserves the right to change these Terms and Conditions at any time without notice. The client’s continued use of our services will constitute acceptance of any revised terms and conditions.
